Dear Chairperson Lofaro and Members of the Planning Board

I write to ask that you adopt a Negative Findings Statement pursuant to the State Environmental Quality Review Act in response to the Final Environmental Impact Statement (FEIS) for the 94 Dune Road LLC’s application to construct 25 condominium units on Dune Road.

As you know, the property and the adjacent area contain acres of wetlands, which are vital ecosystems that are essential in the fight against climate change. The area has been classified by the New York State Department of State as being located in a “Significant Coastal Fish and Wildlife Habitat,” is in a number of significant flood zones, contains New York State Department of Environmental Conservation = mapped seagrass beds, and is listed as a significant scenic area and roadway by the Town of Southampton’s 1999 Comprehensive Plan Update.

Despite this, 94 Dune Road LLC. is seeking to demolish the Dockers restaurant and marina and build 25 condominiums, a tennis court, and a pool — all on a property zoned for just one single-family home.

The impact of building a new, overly dense residential complex in an ecologically fragile and hazardous flood zone area is completely irresponsible. After a review of the Draft Environmental Impact Statement and FEIS, this project is completely at odds with the current zoning and planning goals in the Town of Southampton. The potential impacts cannot be appropriately mitigated, and to allow such a drastic change from one non-conforming use to another would set an extremely dangerous precedent for future developments.

I urge you to adopt a Negative Findings Statement and please deny this proposal and consider preservation alternatives for the property, both for the sake of our environment and community character.
